ART. 155
Mayor's duties
(1) The Mayor performs the following main categories of duties:
a) duties exercised as a representative of the state, under the law;
b) duties related to the relationship with the local council;
c) duties related to the local budget of the administrative-territorial unit;
d) duties regarding the public services provided to citizens, of local interest;
e) other duties established by law.
(2) In accordance with paragraph (1) letter a), the Mayor:
a) performs the function of civil status officer and guardian authority and ensures
the functioning of local public services of this profile;
b) performs duties regarding the organization and conduct of elections, referendums, and census;
c) performs other duties established by law.
(3) In the exercise of the duties provided for in paragraph (1) letter b), the Mayor:
a) presents to the local council, in the first quarter of the year, an annual report on the economic, social, and environmental situation of the administrative-territorial unit, which is published on the website of the administrative-territorial unit, under the conditions provided by law;
b) participates in the meetings of the local council and takes the necessary measures for their proper preparation and conduct;
c) presents, at the request of the local council, other reports and information;
d) develops, following public consultations, draft strategies regarding the economic, social, and environmental situation of the administrative-territorial unit, publishes them on the website of the administrative-territorial unit, and submits them for approval to the local council.
(4) In the exercise of the duties provided for in paragraph (1) letter c), the Mayor:
a) exercises the function of principal credit manager;
b) prepares the budget project of the administrative-territorial unit and the closing account of the budgetary exercise and submits them for approval to the local council, under the conditions and within the deadlines provided by law;
c) presents periodic reports to the local council on budget execution, under the conditions provided by law;
d) initiates, under the conditions provided by law, negotiations for contracting loans and issuing securities on behalf of the administrative-territorial unit;
e) verifies, through specialized departments, the correct tax registration of taxpayers at the territorial tax authority, both for the main headquarters and for secondary locations.
(5) In the exercise of the duties provided for in paragraph (1) letter d), the Mayor:
a) coordinates the provision of local public services of interest through the apparatus of specialization or through specialized entities providing local public and utility services of local interest;
b) takes measures to prevent and, where applicable, manage emergency situations;
c) takes measures to organize and concrete implement activities in the fields provided for in Article 129 paragraph (6) and (7);
d) takes measures to ensure the inventory, statistical records, inspection and control of the provision of local public services provided for in Article 129 paragraph (6) and (7), as well as of the assets of the public and private property of the administrative-territorial unit;
e) appoints, sanctions, and suspends, modifies, and terminates employment relationships or, where applicable, labor relations, under the conditions provided by law, for the personnel within the apparatus of specialization, as well as for the leaders of local public and services of local interest;
f) ensures the development of urban planning plans provided by law, submits them for approval to the local council, and takes action to comply with their provisions;
g) issues opinions, agreements, and authorizations within its competence under the law and other normative acts, subsequently verified and certified by specialized departments, in terms of regularity, legality, and compliance with technical requirements;
h) ensures the completion of works and takes the necessary measures to comply with the commitments assumed in the process of European integration in the field of environmental protection and water management for services provided to citizens.
(6) The Mayor designates specific civil servants to fulfill the obligations regarding the communication of citations and other procedural documents, under the conditions of Law no. 135/2010, with subsequent amendments and completions.
(7) In order to properly exercise his/her duties, the Mayor collaborates with the public decentralized services of ministries and other specialized bodies of central public administration in administrative-territorial units, as well as with the authorities of local and county public administration.
(8) The appointment of the leaders of public institutions of local interest, respectively of local public services of interest, is made based on the competition or examination organized according to the procedures and criteria approved by the local council, at the proposal of the Mayor, under the conditions of Part VI, Title II, Chapter VI or Title III, Chapter IV, as applicable.
ART. 156
Mayor's duties as a representative of the state
(1) In the exercise of the tutelary authority and civil status officer duties, duties arising from the normative acts concerning census, organization and conduct of elections, taking civil protection measures, as well as other duties established by law, the Mayor also acts as a representative of the state in the commune, town, or city where he/she was elected.
(2) In this capacity, the Mayor may request the support of the leaders of decentralized public services of ministries and other specialized bodies of central public administration in the administrative-territorial units, under the law, if the tasks assigned to him/her cannot be solved by the specialized apparatus.
ART. 157
Delegation of duties
(1) The Mayor may delegate, by order, the duties conferred on him/her by law and other normative acts to the Deputy Mayor, the General Secretary of the administrative-territorial unit/subdivision, the leaders of functional compartments or the staff of the specialized apparatus, the public administrator, as well as the leaders of public institutions and local public services of interest, depending on their competence in the respective fields.
(2) The delegation order must specify the period, delegated duties, and the limits of the exercise of the delegated duties, under the penalty of invalidity. The delegation order cannot include all the duties provided by law for the Mayor. Delegation of duties is only carried out with the prior notification of the person to whom the duties are delegated.
(3) The person to whom duties have been delegated under paragraphs (1) and (2) exercises both the duties of the position he/she holds and the delegated duties during the delegation period; subdelegation of duties is prohibited.
(4) The person to whom duties have been delegated under paragraphs (1) and (2) shall be civilly, administratively, or criminally liable, as the case may be, for the acts committed in violation of the law in the exercise of these duties.
