ART. 129
Responsibilities of the local council
(1) The local council has initiative and decides, under the law, on all local interest issues, with the exception of those within the competence of other local or central authorities by law.
(2) The local council exercises the following categories of responsibilities:
a) responsibilities regarding the administrative-territorial unit, its own organization, and the organization and functioning of the mayor's specialized apparatus, public institutions of local interest, and local autonomous companies and authorities;
b) responsibilities regarding the economic-social and environmental development of the commune, town, or city;
c) responsibilities regarding the administration of the public and private domain of the commune, town, or city;
d) responsibilities regarding the management of local interest services;
e) responsibilities regarding inter-institutional cooperation at the national and international levels.
(3) In exercising the responsibilities provided for in paragraph (2) letter a), the local council:
a) approves the statute of the commune, town, or city, as well as the regulations on the organization and functioning of the local council; an indicative model of the territorial administrative unit statute and an indicative model of the local council's organization and functioning regulations are approved by order of the minister responsible;
b) elects the deputy mayor(s) from among the local councilors, at the proposal of the mayor or the local councilors, under the conditions of Art. 152 paragraph (2);
c) approves, under the law, at the proposal of the mayor, the establishment, organization, and staffing of the mayor's specialized apparatus, the public institutions of local interest, the reorganization and staffing of the local autonomous authorities, as well as the establishment, reorganization or dissolution of local interest companies and their staffing;
d) exercises, on behalf of the administrative-territorial unit, all rights and obligations corresponding to the holdings in companies or autonomous authorities, under the law;
e) decides on the establishment or reorganization of institutions, public services, companies, and autonomous authorities, under the law.
(4) In exercising the responsibilities provided for in paragraph (2) letter b), the local council:
a) approves, at the proposal of the mayor, the budget of the administrative-territorial unit, the budget transfers, the use of the budget reserve, and the closing account of the budgetary exercise;
b) approves, at the proposal of the mayor, the contracting and/or guaranteeing of loans, as well as the contracting of local public debt through issuing securities, on behalf of the administrative-territorial unit, under the conditions of the law;
c) establishes and approves local taxes and fees, under the conditions of the law;
d) approves, at the proposal of the mayor, the technical and economic documentation for local investment works, under the conditions of the law;
e) approves strategies for the economic, social, and environmental development of the administrative-territorial unit;
f) ensures a favorable environment for the establishment and/or development of businesses, including the valorization of existing assets, as well as the realization of new investments that contribute to the fulfillment of regional and local economic development programs;
g) ensures the completion of works and takes the necessary measures to implement and comply with the provisions of commitments assumed by Romania as a member state of the European Union in the field of environmental protection and water management for services provided to citizens.
(5) If the budget of the administrative-territorial unit, provided for in paragraph (4) letter a), cannot be adopted after two consecutive sessions, held within a maximum interval of 7 days, activity is carried out based on the previous year's budget until the adoption of the new budget, but no later than 45 days from the date of publication of the state budget law in the Official Gazette of Romania, Part I.
(6) In exercising the responsibilities provided for in paragraph (2) letter c), the local council:
a) decides on the administration, concession, lease, or gratuitous use of public property of the commune, town, or city, as the case may be, as well as of local public services, under the conditions of the law;
b) decides on the sale, administration, concession, gratuitous use, or lease of private property of the commune, town, or city, as the case may be, under the conditions of the law;
c) provides opinions or approves, under the conditions of the law, the territorial planning and urbanism documentation of localities;
d) assigns or changes, under the conditions of the law, names of streets, squares, and any other objectives of local public interest.
(7) In exercising the responsibilities provided for in paragraph (2) letter d), the local council ensures, within its competence and under the conditions of the law, the framework necessary for the provision of local public services regarding:
a) education;
b) social services for child protection, persons with disabilities, the elderly, families, and other individuals or groups in need;
c) health;
d) culture;
e) youth;
f) sports;
g) public order;
h) emergency situations;
i) environmental protection and restoration;
j) the conservation, restoration, and promotion of historical and architectural monuments, public parks and gardens, and natural reserves;
k) urban development;
l) personal records;
m) bridges and public roads;
n) community public utility services of local interest;
o) emergency services such as mountain rescue, lifeguarding, and first aid;
p) social-community administration activities;
q) social housing and other housing units owned or administered by the administrative-territorial unit;
r) the valorization, in the interest of the local community, of the natural resources within the administrative-territorial unit;
s) other local public services established by law.
(8) In exercising the responsibilities provided for in paragraph (2) letter d), the local council:
a) supports, under the conditions of the law, the activity of religious cults;
b) approves the construction of social housing, the criteria for allocating social housing and the use of housing utilities owned or administered by the local council.
(9) In exercising the responsibilities provided for in paragraph (2) letter e), the local council:
a) decides, under the conditions of the law, on cooperation or association with Romanian or foreign legal entities for the joint financing and implementation of actions, works, services, or projects of local public interest;
b) decides, under the conditions of the law, on twinning the commune, town, or city with administrative-territorial units in other countries;
c) decides, under the conditions of the law, on cooperation or association with other administrative-territorial units from the country or abroad, as well as on joining national and international associations of local public administration authorities, for the promotion of common interests.
(10) In exercising the responsibilities provided for in paragraph (2) letter a), b), and d), the local council:
a) may provide, in whole or in part, with the agreement of the owner or administrator, the works and funds necessary for the rehabilitation, equipping, and functioning of buildings where authorities or public institutions whose activity has local interest are located. The goods purchased for equipment remain the property of the administrative-territorial unit;
b) may provide, in whole or in part, with the agreement of the institution or public authority holding the right of ownership or administration, works for the arrangement, equipping, and maintenance of buildings or land owned by the state, for the purpose of increasing the attractiveness of the administrative-territorial unit for tourism, on the condition that the express agreement allows public access to the improved spaces for a minimum period of 5 years. The goods purchased for equipment remain the property of the administrative-territorial unit.
(11) In order to fulfill the responsibilities provided for in paragraph (2), the local council may request information and reports from the mayor, deputy mayor, and heads of public service providers and local utility companies of interest.
(12) The local council decides on the granting of supplements and other benefits, according to the law, to the personnel employed in the mayor's specialized apparatus and local public services of interest.
(13) The local council may confer the title of honorary citizen of the commune, town, or city, based on its own regulations, to Romanian or foreign individuals with outstanding merits. This regulations also establish the conditions for withdrawing the bestowed title. These regulations may be an integral part of the administrative-territorial unit's statute.
(14) The local council performs any other responsibilities in all areas of local interest, with the exception of those expressly delegated to other public authorities, as well as any other responsibilities established by law.
