The role, appointment and removal from office of the deputy mayor
(1) The vice mayor is subordinate to the mayor and, in situations provided by law,
acts as the mayor's legal substitute, exercising the mayor's duties on their behalf. The mayor can delegate some of their duties to the vice mayor.
(2) The vice mayor is elected, by secret ballot, with an absolute majority, from among the members
of the local council, at the proposal of the mayor or the local councilors.
(3) Voting is done by ballot. The election of the vice mayor is
carried out by a decision of the local council.
(4) If two vice mayors are elected, the candidates who have
obtained an absolute majority vote are declared elected. In this situation, the local council designates, by
decision, which of the two vice mayors will serve as the mayor's legal substitute.
(5) The removal from office of the vice mayor can be done by the local council, by adopting a
decision, by secret ballot, with the majority of two-thirds of the number of councilors in office, at the
well-founded proposal of the mayor or one third of the number of local councilors
in office. The removal from office of the vice mayor cannot be done in the last 6 months of the
term of the local council.
(6) The local councilor who is running for the position of vice mayor, respectively the vice mayor
in office whose change is proposed, shall participate in the deliberation and adoption of decisions regarding the election or removal from
office of the vice mayor.
(7) During their term of office, the vice mayor retains their status as a local councilor,
without receiving the corresponding allowance, being subject to the
incompatibilities specific to the position of vice mayor provided for in Book I, Title IV of Law no. 161/2003, with
subsequent amendments and completions.
(8) The term of office of the vice mayor is equal to the term of office of the local council. In
the event that the term of office of the local council ceases or the status of local councilor ceases,
before the normal duration of 4 years expires, the
term of office of the vice mayor also ceases, without any other formality.
